Wealthy venture capitalist Greg Emerson is murdered in his home. The scene initially looks like a burglary - but when it emerges the house's hi-tech security system had been disabled, suspicion falls on Kenny Tremont, who installed the system. Tremont admits to having an affair with Emerson's wife Marley, and there is evidence that he disabled the alarm right before the murder. Marley accepts a plea deal to testify against Tremont but before she can do so, she's killed by carbon monoxide poisoning when the central heating system (also installed by Tremont) malfunctions.

Tremont's defence now gets the charges for Emerson's murder thrown out - without Marley's testimony, there's no case. But the detectives find DNA evidence that Tremont tampered with the heating system. The judge allows him to be tried for Marley's murder on condition that the prosecution may not state what offence Tremont was charged with at the time of Marley's death. Tremont's girlfriend gives him an alibi, but McCoy lures her into admitting Tremont told her he and Marley conspired to kill Emerson. The judge decrees this fair, and now allows a recording of Marley (from the Grand Jury hearing over Emerson's death) to be admitted as evidence. Tremont is convicted.
