I don’t think it’s beneficial for this to be here, particularly in a section discussing police laziness. While not technically incorrect, this factoid exists on the internet as little more than a “Redditorism” for enraged people to try and show how hopelessly corrupt/evil/corporate/greedy the United States is, usually in comparison to supposedly more ‘enlightened’ countries, and pretty much always without putting in any effort to actually understand why this legal decision exists or the reasoning behind it. Here is the short version: Citizens do not have a right to legal recompense merely because crime exists. Citizens cannot say “The police have a legal duty to prevent crime occurring to me. Yet, crime exists. Therefore, the police have failed in their legal duty to prevent crime, and I am entitled to restitution.”As far as I am aware, there is no society in the world where victims of crime are entitled to restitution from the state merely because they are victims of crime. And therefore there is no society where police have a legal duty to prevent crime to individuals. Furthermore, this by no means implies that police officers and departments are insulated from administrative or criminal penalties for dereliction of duty, incompetence, negligence, etc, nor that police are given discretion to enforce the law whenever they like. Indeed, the legal decision explicitly mentions police officers facing up to two years in prison for failing to make a justified arrest.
