Are the unlockable games really spoilers? I mean, for one thing, even the initial set of games are technically unlockable (you unlock them by clearing the first stage...) and also, the characters from the unlockable games are all on the opening load screen and title screen, so they're not huge secrets.

The games are not spoilers. In Nintendo's own eShop, the page for NES Remix has an obvious Zelda screenshot and a tag for Zelda. Yes, The Legend of Zelda is in NES Remix! Today's ad, on the front page of the eShop, lists 12 of the 16 games. Reviews on the internet list all 16 games.

ROM Hacks? More often than not, they can do what's physically impossible on the actual NES.

It's more apparent with certain stages that contain backgrounds that's impossible to do (like a gradient one in a Mario Bros. challenge), or even give the illusion that the sprites are casting into the background.

More likely, those games are very elaborate remakes of the original. (Just like those 3D Classics on the 3DS.)

I don't think the implication is that it's literally a ROM hack, but more that it serves the same purpose as ROM hacks in altering the behavior of the game. It's more like those fan-made scripts that add mouse controls to Super Mario Bros.
