With regard to the Harry Potter example, I think it is only really one specific wand that is transferred to a new owner only by violent means.

Wands are described as having personalities of sorts, and there are very probably wands that prefer to be given as gift, etc.

"Empathic" seems to be the wrong word to describe "a weapon with a mind of its own". "Empathy" is not "something having a mind of their own", IIRC.
