Nicole's death in the remastered version of Gundam SEED is NOT this trope, because it doesn't change either the outcome or the faults of the people involved. Due to the staging of the event it was clear that Nicole didn't have enough time to react to the placement of the sword, while also keeping into account that Kira was not thinking properly as he was trying to avoid Nicole's attack.

In fact, if anything the scene makes Kira more guilty than Nicol because he wasn't thinking about the anti-ship sword that can easily cut through mobile suits when he was avoiding the attack. So how is it this trope when the original perp looks MORE GUILTY than in the original? Isn't it supposed to be the other way around?

In the original version, Kira is fighting Athrun, Nichol tries to blindside him, and Kira deliberately cuts him in half. Reflexive, maybe, and if he had more time to think it through he may not have done it, but definitely not accidental. In the remake, Kira's clearly backing away rather than attacking, and Nichol's death is more accidental than deliberate.

There's a huge difference in the level of responsibility from "deliberately (if unthinkingly) attacked" and "tried to back off and opponent literally fell on your sword". The point of The Dog Shot First is to make the character in question more heroic by removing moral ambiguity. The Gundam Seed example definitely qualifies.

How is it in anyway herioc? It just makes both characters look like idiots. It doesn't count because although it looks like Kira is backing away, look where he's placing his sword. How is that any less morally ambiguous. It isn't, because that wasn't the point of either version. The point was that Kira wasn't thinking about attacking Nicol as much as he was more concerned with dodging his attack. Not only that, but to show that it doesn't make Kira in anyway heroic, Kira knows that his anti-ship sword can cut through a mobile suit, he's done it multiple times. In order for Kira to look in anyway "heroic" in this scene would be if he dropped the anti-ship sword and THEN Nicol ran into it, but that's not what happens. What happens is still the same as the original version of the scene, in that Kira isn't thinking about anything other than "the Blitz is running at me and is about to stab my cockpit!" and attempting to move out of the way.

Look, I get that you might see it as such, but that doesn't mean it is. I will grant you that it was not the best way of restoring what was originally a very unimpressive animated moment, but aside from making Kira heroic or guilt free, it just isn't the case. Kira still looks like an idiot for not being careful with his sword and Nicol still didn't think his attack through.

The happens in the 4th book of The Vampire Diaries, they retcon Damon's only legit Murder into an act of Self Defense.
