The NCIS team find their plans being interrupted when they discover errors in a seemingly cut and dried case that has apparently been closed. As the team work to find out what's gone wrong in the case, McGee and Delilah argue over the importance of not discussing work during dinner while DiNozzo bores his date with shop talk.

- Asshole Victim: One of several factors encouraging the team to wrap the case early is the fact that the victim has an extensive rap sheet for violent assault and sexual harassment, while the Navy officer who shot him has a spotless record and is active in several local charities.
- Attempted Rape: What it looks like at first, with the navy man shooting the rapist to save the woman. It turns out that the woman was the shooter, and her victim had raped her when she was in jail. The navy man had tried to make himself look like the shooter.
