This is not universally true, and even less likely to be true at the time the story is set. Just one example, currently in Washington State guards are allowed to fire at a fleeing prison inmate regardless of their crime if a warning shot is fired first.


* ''Film/TheShawshankRedemption'': The Warden has an inmate killed, making it look like a case of him being shot while attempting escape because the prisoner in question [[HeKnowsTooMuch has evidence that would exonerate the Warden's meal ticket]]. In reality, shooting an unarmed prisoner, even during an escape attempt, would trigger a serious investigation, as ideally, inmates attempting escape are supposed to be recaptured alive. Also, bed checks and cell inspections really should have turned up the rather large hole that Andy Dufrense had made in his cell wall. Certainly, regular maintenance of the plumbing system would have probably uncovered the hole from the other side long before the escape attempt was made.
