* Watson published "The Final Problem" in 1893, well over two years after the events described in this book. It's possible that the 'real' Professor Moriarty happened to die during this time, so Watson was able to use his name in the story. Its likely that Moriarty didn't have any relatives or heirs (or at any rate, none who could cause trouble). And Watson, at the end of the book, sympathizes with Holmes' perception of Moriarty as a villain (due to the latter's affair with Holmes' mother), so he probably didn't have too many scruples about using Moriarty's name for a fictitious "Napolean of Crime".
