Gonna argue no here. In their first meeting, Holmes was seen visiting him by a witness and there was no readily apparent way to kill him without drawing suspicion on himself. This /could/ apply to when he has Holmes in his clutches in the factory, but the goal of torturing him was to find out what was on the telegram Watson sent (presumably he would have killed him afterwards).

He's right, as the assassin is the only person in the room who doesn't turn around to see where the noise came from.

* ArtisticLicenseGeography : Sherlock locates Moriarty by making the following deduction: deduction, quoted below. What's wrong about it? About everything. There were only six mainline stations in Paris in 1891, none of which are close to the Tuileries (the nearest would be the Gare Saint Lazare). And If you would indeed have to take a train at the Gare du Nord to get to Berlin, the direct line runs approximately 300 miles north of Heilbronn.
