IIRC they don't have the rights to anything except The original Lord of the Rings book and the The Hobbit. That was why the hobbit movie had to skirt around the names of the blue wizards because they weren't named in the works they had the rights to.
At best, it's going to be based on Lot R's appendices I would think.
