f4: The 1977 Geneva Conventions Article 39 states:

"3. Nothing in this Article or in Article 37, paragraph 1 (d)Database 'IHL - Treaties & Comments', View '1.Traités \1.2. Par Article', shall affect the existing generally recognized rules of international law applicable to espionage or to the use of flags in the conduct of armed conflict at sea."

The act of rescuing prisoners while dressed as the enemy comes under law applicable to espionage, and not to open warfare.

Silent Hunter: Nice find, but that doesn't always apply here. Anyway, it's very hard to disguise a "Kirov" class heavy cruiser as an Arleigh Burke (or the radar for that matter).

It should also be pointed out that one must raise their true colours before opening fire.

Nybbler: Since the generally recognized rules, etc. as applied to espionage allow execution of the spy, that Article is of cold comfort to them. And let's face it; the Evil Overlord usually isn't a signatory to the Geneva Conventions, nor does he make any pretense of following its rules.
