A type of Morton's Fork- both choices end in prison, but one does not also return him to a country he probably left for a reason.

This could become a choice between the Lesser of Two Evils with a shift in perspective or circumstances- say, for the prosecutor the decision is framed as a choice between deporting a witness for testimony that could convict a serious crime, or allowing him to falsely change his testimony and potentially let a dangerous criminal go free without that testimony.
